Terms of Service

1. Agreement to Terms

By creating an account or using BrightKeep, you agree to these Terms of Service. If you don’t agree, please don’t use the service.

You must be at least 18 years old to create an account. By using BrightKeep, you represent that you are 18 or older and have the legal capacity to enter into this agreement.

2. Description of Service

BrightKeep is a personal life data platform. We store, process, and organize documents and personal information you upload. We use AI to extract and structure data from your documents — turning insurance cards, medical records, school forms, and other family documents into organized, searchable information.

The service includes document storage, AI-powered data extraction, a natural-language assistant, automated reminders, and secure credential management.

3. User Accounts

You are responsible for maintaining the security of your account credentials, including your password and any multi-factor authentication methods. One account per person.

You may invite family members to access your BrightKeep account with permissions you define. You are responsible for the actions of anyone you grant access to.

If you believe your account has been compromised, contact us immediately at support@brightkeep.ai.

4. Acceptable Use

You agree not to:

  • Upload illegal content or documents you don’t have the right to store
  • Use the service to harm, harass, or defraud others
  • Attempt to reverse engineer, decompile, or extract the source code of BrightKeep
  • Share your account credentials with anyone outside your immediate family
  • Use the service for any commercial purpose beyond personal family management
  • Interfere with or disrupt the service or its infrastructure

We reserve the right to suspend or terminate accounts that violate these terms.

5. Your Data

You own your data.Everything you upload to BrightKeep remains yours. We don’t sell your data. We don’t use it to train AI models. We process it only to provide the service you’re paying for.

You can export all of your data at any time. You can delete your account and all associated data at any time. See our Privacy Policy for full details on how we handle your information.

6. Service Availability & Modifications

BrightKeep is provided on an “as available” basis. We do not guarantee uninterrupted or error-free access to the service.

We reserve the right, at our sole discretion and at any time, to:

  • Modify, update, or discontinue any feature, module, or functionality of the platform, with or without notice
  • Suspend or discontinue the service entirely, whether temporarily or permanently
  • Change, limit, or impose new conditions on the use of any part of the service

If we permanently discontinue the service, we will make reasonable efforts to provide at least 30 days’ notice and a means to export your data before deletion.

Promotional Offers & Credits

Any promotional pricing, free trials, complimentary access codes, or credits are provided at our sole discretion. We may modify, limit, or revoke any promotional offer at any time, including during an active promotional period, without obligation to honor the offer for any specific duration. Promotional offers have no cash value and are non-transferable unless explicitly stated otherwise.

7. AI Processing

Documents you upload are processed by AI (Anthropic Claude) to extract structured information — names, dates, policy numbers, medical details, and other relevant data.

This processing happens via API calls to Anthropic. We send document content to Anthropic’s API for extraction. Anthropic does not retain this data per their data processing terms. Your documents are not used to train Anthropic’s models.

BrightKeep also generates document comparisons — highlighting differences between two versions of a document or between your existing records and new documents you upload. These comparisons identify field-level changes and may include assessments of whether changes appear favorable or unfavorable. Comparisons are informational summaries, not professional advice. Always consult a qualified professional — such as your insurance agent, doctor, financial advisor, or attorney — before making decisions based on comparison results.

AI-generated extractions and comparisons may contain errors. While we strive for accuracy, you should always verify important information — especially medical details, policy terms, legal documents, and financial figures. BrightKeep is a reference tool, not a substitute for reading your actual documents.

8. Limitation of Liability

The service is provided “as is” and “as available” without warranties of any kind, whether express or implied.

We are not liable for:

  • Data loss due to circumstances beyond our reasonable control
  • Errors in AI-extracted information, including document comparisons
  • Security breaches beyond our reasonable control, despite our best efforts
  • Decisions you make based on information stored in or generated by the platform
  • Service interruptions or downtime
  • Service interruptions, modifications, or discontinuation, including any resulting data loss after a reasonable export period

Our total liability to you is limited to the amount you’ve paid for BrightKeep in the 12 months preceding any claim.

BrightKeep is not a legal, medical, financial, or insurance advisor. Information in BrightKeep is for personal reference only. Always consult qualified professionals for important decisions.

9. Data Security

We take the security of your data seriously. We use encryption at rest (AES-256) and in transit (TLS), per-field encryption for vault credentials, and access logging for sensitive operations.

That said, no system is 100% secure. We will notify you of any data breach within 72 hours of discovery, as required by applicable law.

By using BrightKeep, you acknowledge the inherent risks of storing sensitive personal information in any cloud-based system and agree that our security measures represent a reasonable standard of care.

10. Subscription & Billing

BrightKeep is a paid subscription service, billed monthly at the start of each billing period. All billing is processed through Stripe — we never store your payment card information directly.

If you cancel, your access continues through the end of your current paid period. We do not provide refunds for partial months.

We may change our pricing at any time with 30 days’ written notice. We are under no obligation to maintain any particular price or plan structure. If you don’t agree with a price change, your sole remedy is to cancel your subscription before the new pricing takes effect.

11. Termination

You can cancel your account at any time from the Settings page.

We may terminate or suspend accounts that violate these terms. We’ll provide notice when possible, but reserve the right to act immediately in cases of serious violations.

On termination — whether by you or by us — you have 30 days to export your data. After 30 days, your data will be permanently deleted.

12. Changes to Terms

We may update these terms from time to time. When we make material changes, we’ll notify you via email at least 30 days before the changes take effect.

Continued use of BrightKeep after changes take effect constitutes acceptance of the updated terms.

13. Governing Law

These terms are governed by the laws of the State of New York, without regard to its conflict of law provisions. Any disputes arising from these terms or your use of BrightKeep will be resolved in the courts of the State of New York.

14. SMS Notifications

BrightKeep offers optional SMS notifications for escalation alerts, daily digests, document shares, and annual review reminders. SMS is off by default and requires explicit opt-in via your account settings.

By enabling SMS notifications, you consent to receive automated text messages at the phone number on your account. Message frequency varies (typically 0–3 per day). Message and data rates may apply.

You may opt out at any time by replying STOP to any message or disabling SMS in settings. Reply HELP for assistance. For full details, see our SMS Opt-In Information page.

We do not sell or share your phone number with third parties for marketing purposes. Your number is used solely to deliver BrightKeep service notifications.
